Dealers1 Privacy Policy

Dealers1, LLC (“D1”) delivers safety, security and peace of mind to 21st century drivers by providing tools to connect you with your car, diagnose repair issues on the fly, and improve your driving habits as well as those of your family members, such as teen drivers. In order to provide these services, Dealers1 collects information about you, your car, your driving habits, and other attributes.

This privacy policy has been compiled to better serve those who are concerned with how their 'Personally Identifiable Information' (“PII”) is being used online. PII, as described in US privacy laws and information security, is information that can be used on its own or in combination with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website and mobile app.

What personal information do we collect from the people that visit our website or use our mobile app?

First, we retain information you submit when you purchase your new automobile. This information typically includes your name, address, phone, and email address. We will never ask for your social security number. We may also retain payment information, such as credit card details in order to facilitate future purchases by you. We also capture your VIN, or vehicle identification number, that is associated with you.

Other information is collected by automated means via your downloadable mobile app. If you use the app we may collect the following information: the location of your mobile device over time, the type of device used, IP address, unique ID of the device installed in your car, driving behaviors, and your usage of the mobile app.

Additional automated information is collected via the OBD device itself. When used in conjunction with the mobile OBD device, we may gather information concerning the health and performance of your car, such as speed, battery voltage levels, hard stops and starts, diagnostic codes as reported by the vehicle per the device, and the geolocation of that device. As further services are developed we may obtain other data through the OBD device, which, if we do, will be specified in this Privacy Policy.

When do we collect information?

We collect information from you when you register on our site, enter information on our site, or purchase a new vehicle that contains a Dealers1 OBD telemetric device. When you drive with an installed OBD device in conjunction with the app we may also collect information that is generated from your driving.

How do we use your information?

We may use the information we collect from you in the following ways:

To personalize your experience and to allow us to deliver the type of content and product offerings in which you are most interested.

To improve our mobile app in order to better serve you.

To quickly process transactions.

To follow up after correspondence (live chat, email or phone inquiries)

To provide insights to your service advisor at the dealership where you purchased our vehicle that can improve their ability to diagnose, treat and maintain your vehicle.

How do we protect your information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible, and we use regular Malware Scanning. We do not store your personally identifiable information in a singular or “whole” fashion, so there is no single point of failure.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are processed through a gateway provider and are not stored or processed on our servers.

What do we do with your information?

We may use your PII as follows.

To provide, support, and improve the services we offer. This includes aggregating information from your use of the Service and sharing such aggregated information with third parties.

To send you informational and promotional content that you may choose (or “opt in”) to receive. You can stop receiving our promotional emails by following the unsubscribe instructions included in every email.

To meet legal requirements like complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.

To provide information to representatives and advisors, like attorneys and accountants, to help us comply with legal, accounting, or security requirements.

To prosecute and defend a court, arbitration, or similar legal proceeding.

To provide, support, and improve the Services we offer. This includes aggregating information from your use of the Services and sharing such aggregated information with third parties.

To provide suggestions to you. This includes suggestions to improve your car ownership experience.

To transfer your information in the case of a sale, merger, consolidation, liquidation, reorganization, or acquisition. In that event, any acquirer will be subject to our obligations under this Privacy Policy, including your rights to access and choice. We’ll notify you of the change either by sending you an email or posting a notice on our Website.

Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your PII unless we provide users with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property or safety.

However, aggregated and non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

We may de-identify your Personal Information so that you are not identified as an individual, and provide that information to our partners. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner in a manner that would identify you as an individual person.

Advertisers: We may allow advertisers and/or merchant partners ("Advertisers") to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in Beaverton to show you ads or offers for Beaverton businesses, but we will not tell such businesses who you are.

We may deliver a file to you through the Services (known as a "web beacon") from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network's servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.

Affiliated Businesses and Third Party Websites We Do Not Control: In certain situations, businesses or third party websites we're affiliated with may sell items or provide services to you through the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your PII with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit third party account information to your Service profile or to automatically transmit information in your Service profile to your third party account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business' or websites' policies.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
